Welcome to the legal page of BLACK TIE LIVERY CORPORATION. The purpose of this page is to create an understanding between the parties involved in the contracting of vehicle service. 

RESERVATIONS/DEPOSITS

    When contacting us to reserve service, we may extend a 24 to 48-hour courtesy hold on the vehicle and time you have requested without a deposit.  The duration of time we will agree to hold the vehicle without a deposit depends on several factors such as amount of time until event and anticipated demand for vehicle.  After the stated time has expired without receiving a deposit, the vehicle will be available to the general public.  There is no financial burden to you if a deposit is not received by us.  If a deposit is received within the stated timeframe, the vehicle will be reserved for the contracted date and time specified.  Once the deposit is received, we do not allow other parties to reserve any overlapping time slots.  For this reason, all deposits are nonrefundable.  Additionally, once the deposit is received, the contracting party is liable for the entire payment of the contract and may not cancel and remove their financial liability.  You will be asked to sign a contract to verify your agreement to the terms above.  The deposits will be a percentage of the total invoice quote.  The following statements about deposits are general, and may altered from time to time.  

PAYMENT OF BALANCE

    Depending on the amount of time until the contracted event, the balance of the contract will be due at least two weeks prior to the event.  Service that is requested within two weeks of the event will be required to have the balance paid within three days of the event.  Service that is requested within three days of the event will require payment in full within 24 hours of the event.  Failure to pay the balance prior to the date stated on the contract may result in an implied cancellation of service, but will not result in any reduction in financial liability for contracted service. 

CANCELLATION

    We realize that people's schedules change.  Sometimes the change is beyond their control.  Unfortunately we cannot incur the financial risk produced by the contracting parties change in schedule, whether or not the circumstances are within their control.  A contract that is cancelled by the contracting party, either by written notice, verbal notice, or by failure to pay the balance within the time specified on the contract, is still liable for the full invoiced amount.  A contract that is cancelled by any means listed prior will absolve BLACK TIE LIVERY CORPORATION from having to perform any duties described within the contract.  An alternative that we offer is to allow the contracting party to reschedule the event so long as more than 48 hours notice prior to the event is given.  Essentially, the balance of the contract is still required to be paid in full within the specified timeframe, but the credit may be applied to future service with the company, subject to rescheduling charges as described below. 

RESCHEDULING

    Once a deposit has been received by us and a contract signed by you, changes by you to the date, time and vehicle reserved will only be allowed at the sole discretion of BLACK TIE LIVERY CORPORATION.  We may have contracted other service at adjacent time slots which may not allow altering your contracted time.  Changes will be subject to a $25.00 charge per request.

OVERTIME

    There are two types of service categories provided by BLACK TIE LIVERY CORPORATION.  They are transfers and hourly service.  Overtime is calculated differently for each category.  Transfers are point to point transportation where the client specifies a pick-up and drop-off location.  Airport transfers are the most common example of this service.  The client pays an agreed upon amount for transportation between points and does not incur any penalties for time which result from traffic conditions.  Overtime for transfers will result from the client being late to enter the vehicle at the initial pick-up location or from requesting route deviations or stops that were not specified in the contract.  The overtime charge will be the accumulation of time for late vehicle entry, requested route deviations and requested stops.  Overtime for hourly service is calculated by computing the amount of time until the clients exit the vehicle beyond their scheduled time and rounding the amount up to the nearest 15 minute interval.  Overtime will be charged at 1.5 times the standard hourly rate that is assigned to the contract.

GENERAL RULES

No smoking in vehicles.  The first offense will result in a $250.00 fine.  The second offense will result in termination of the service and ejection of the entire party at the nearest safe location.

Contracting party is responsible for damage caused by them or their guests.  The contracting party will be financially liable for payment for all damages caused by them or any of their guests plus a $150.00 fee to cover out-of-service costs plus other inconveniences.

Vehicle substitution.  BLACK TIE LIVERY CORPORATION reserves the right to substitute a vehicle of equal or greater value at its sole discretion. 

Seat belts.  By law, the rear seat passengers are not required to wear a seat belt.  At the recommendation of our insurance company we urge back seat passengers to wear their seat belts.
